Smart Dining is a restaurant operations platform designed to help restaurants manage reservations, waitlists, floor operations, orders, guest communication, and related workflows.

“Smart Dining”, “we”, “our”, or “us” refers to Smart Dining and its operators. “You” or “Customer” refers to the restaurant, business, or individual using the Services.

You must be at least 18 years old and authorized to represent a restaurant or business to use Smart Dining.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity occurring under your account
• Ensuring your account information is accurate and current

You agree to use Smart Dining only for lawful business purposes and in compliance with applicable laws.

You must not:

• Attempt to reverse engineer, copy, or disrupt the Services
• Access data belonging to other restaurants
• Use communication tools to spam or mislead guests
• Upload or transmit unlawful, harmful, or malicious content

We may suspend or terminate access if we reasonably believe the Services are being misused.

Restaurants retain ownership of their data, including guest information, reservations, waitlists, orders, and operational records.

Smart Dining processes this data only to provide and improve the Services. We do not sell guest or restaurant data.

Restaurants are responsible for complying with local privacy and data protection laws when using Smart Dining.

Smart Dining may integrate with third-party services such as POS systems, SMS providers, WhatsApp, Google Business, online widgets, or other platforms.

We are not responsible for the availability, performance, or data practices of third-party services. Your use of integrations may also be subject to third-party terms.

Some features of Smart Dining may require a paid subscription. Fees and billing intervals depend on the plan you select.

• Payments are due according to your plan
• Fees are non-refundable unless otherwise required by law
• Non-payment may lead to suspension or termination

Smart Dining and its licensors own all rights, title, and interest in the Services, including software, designs, branding, and documentation.

You are granted a limited, non-exclusive, non-transferable license to use the Services while your account remains active.

Smart Dining aims to provide reliable access, but we do not guarantee uninterrupted availability.

We may modify, update, or discontinue features, and we may perform maintenance that temporarily affects availability.

You may stop using Smart Dining at any time.

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or if required to protect the security and integrity of the Services.

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Smart Dining shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, data, or business opportunities.

Our total liability shall not exceed the fees paid by you to Smart Dining in the twelve (12) months preceding the event giving rise to the claim.

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date.

Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

These Terms are governed by the laws applicable to Smart Dining’s operating jurisdiction, without regard to conflict-of-law principles.
